Can I swap expensive appliances?

Let’s say you spent a bundle on a gourmet kitchen with top-of-the-line appliances. Can you switch one or more of them for cheaper models before closing? You already know the answer, but here it is in black and white: no. If ‘appliances’ were included in the agreement, even if it didn’t specify makes and models, they are the ones your buyer saw and they are what your buyer gets.

You’ll see references in the agreement to ‘fixtures’ and ‘chattels’. Fixtures are things that are stuck to the structure, like a toilet, water pump and ceiling lighting. Chattels are things that are movable like furniture, appliances, artwork and canoes. Fixtures are generally included by default; chattels are generally excluded. If you want to keep a fixture, or a specific chattel when others are part of the sale, make sure you list these in the agreement. Otherwise, you’ve sold those specific items with the property.
